Copyright and takedowns
Last updated
We respect the rights of creators and brands. This page explains how to report copyright infringement on Scenta, how to respond if your content was removed, and how we handle repeat infringers.
Our approach
Scenta stores facts about fragrances (names, notes, accords, perfumers, years) and what our community shares. We don't copy brand descriptions or retailer photos, and our guidelines ask people to share only their own photos and words. If something on Scenta infringes your copyright, tell us and we will act quickly.
Where to send a notice
Send notices to our designated copyright agent:
Copyright agent, Early Rocket, LLC131 Continental Drive, Suite 305, Newark, DE 19713, United Statessupport@scenta.appEmail is fastest. This address is only for copyright notices; other messages won't get a reply from it.
What a notice must include
Under the US Digital Millennium Copyright Act (DMCA), a notice must include:
- your physical or electronic signature (typing your full name is enough by email);
- the copyrighted work you believe is infringed;
- where the material is in Scenta, specific enough for us to find it: the fragrance, the profile handle, or a screenshot, plus what the material is (a photo, review or comment);
- your name, postal address, phone number and email address;
- a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law;
- a statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act for them.
Knowingly misrepresenting that material infringes can make you liable for damages. If you are unsure, consider whether the use might be fair use, or ask a lawyer first.
What happens next
When we receive a complete notice, we remove or disable access to the material promptly, tell the person who posted it, and send them a copy of the notice (we may remove personal contact details first). Incomplete notices get a reply asking for the missing information.
Counter-notices
If your material was removed and you believe that was a mistake or that you had the right to post it, you can send a counter-notice to the same agent. It must include:
- your physical or electronic signature;
- the material that was removed and where it appeared;
- a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification;
- your name, address and phone number;
- a statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the United States, any judicial district where we may be found) and that you will accept service of process from the person who sent the original notice or their agent.
We forward the counter-notice to the person who sent the original notice. Unless they tell us within 10 business days that they have filed a court action to stop the infringement, we restore the material within 10 to 14 business days after receiving the counter-notice.
Repeat infringers
We close the accounts of people who repeatedly infringe copyright, in appropriate circumstances. Each valid notice against an account counts as a strike, unless it was withdrawn or successfully countered.
Trademarks and catalog data
Fragrance and brand names are used only to identify products, with no logos and no suggestion of endorsement. If you own a trademark and believe it is being misused, email support@scenta.app with details.
Our catalog started from third-party datasets, listed on the attributions page. We keep the source of every catalog fact, so if you hold rights in one of these datasets and object to its use, contact the copyright agent and we can remove that source's data.
